Green Hydrogen in Colombia: Regulation, Incentives, and Sustainable Energy Transition

In the search for sustainable and unconventional alternatives for energy generation, green hydrogen emerges as a promising solution and a source of clean and renewable energy. Green hydrogen is positioned as a strategic energy resource.

Bogotá– However, it is important to highlight that this qualification does not automatically enable the production of green hydrogen for any purpose within the framework of Colombian legislation governing public utility and social interest.

Article 56 of Law 142 of 1994, Article 5 of Law 143 of 1994, and literal d) of Article 58 of Law 388 of 1997 consider properties and activities associated with the provision of public utility services, as well as the activities of generation, transmission, and distribution, to be of public utility and social interest.

Article 3 of Law 2099 of 2021, which amends Article 4 of Law 1715 of 2014, establishes that: “The promotion, stimulation, and incentive for the development of activities related to the production, utilization, storage, administration, operation, and maintenance of unconventional sources of energy, mainly those of a renewable nature, as well as the efficient use of energy, are declared matters of public utility, social interest, public, and national convenience.”

Nevertheless, Articles 16, 17, and 18 of Law 56 of 1981 specify that this classification applies solely to plans, projects, and the execution of works related to the generation, transmission, and distribution of electrical energy, as well as to the areas affected by these activities.

For this reason, in order to promote investment in green hydrogen, governments and companies can implement a series of incentives. These may include subsidies, financial support, government purchases, research and development programs, investments in infrastructure, and the establishment of clear standards and regulations. These measures will foster the adoption and deployment of technologies related to green hydrogen, thereby accelerating the transition towards a more sustainable energy system.
